Microsoft can’t seem to catch a break. After taking so long to resolve the red ring of death issue (which still lingers in older units), it’s now facing a class action lawsuit over double billing.
Ryan Graves of Bloomington, Indiana has filed a suit against Microsoft at the U.S. District Court in Seattle, stating that customers are being double billed for Xbox Live services without their consent.
Microsoft did attempt to offer Ryan two free years of Xbox Live service, but that would mean billing for two years, to which Ryan objected.
The suit is seeking restitution, statutory, treble and punitive damages for breach of contract, unjust enrichment, conversion and violation of the Electronic Funds Transfer Act. Ryan is also looking for Microsoft to "reverse all unlawful, unfair, or otherwise improper charges, and to cease and desist from engaging in further unlawful conduct in the future."
