A report in Variety says Activision claims it still own the publishing rights of Double Fine's Brutal Legend. Originally to be published by Vivendi Games' Sierra Entertainment, Brütal Legend is a third person Action/Adventure game starring Jack Black in the role of roadie Eddie Riggs, who is drawn back through time to a mythical world where he is forced to build an army of rockers to free an oppressed group of people.
According to the Hollywood trade paper, Activision Blizzard has written a letter to Electronic Arts informing the latter Activision believes that it was still in negotiations with Double Fine when EA acquired the publishing rights of Brutal Legend and as result Activision considers the EA deal invalid. Variety speculates Activision may be looking for money in exchange for giving up the publishing rights of the game.
EA has provided to Variety's with the following response:
We doubt that Activision would try to sue. That would be like a husband abandoning his family and then suing after his wife meets a better looking guy.
