Gamasutra has posted news regarding a lawsuit filed by Fallout rights holder Bethesda Softworks against developer Interplay for allegedly failing to carry out their part of the original agreement between the two parties from April of 2007, when Bethesda purchased the rights to the Fallout series for $5.75 million.
On September 9, 2009, Bethesda filed a complaint with the U.S. District Court of Maryland requesting a preliminary and permanent injunction against Interplay's manufacture, sale and distribution of Fallout Trilogy, which includes the trio of titles Fallout, Fallout 2 and Fallout Tactics.
While Interplay was in fact permitted to sell pre-existing Fallout games, Bethesda claims that Interplay never held up their end of the deal by submitting all related packaging, advertising and promotional materials to the publisher before such titles were released. Therefore, Bethesda is taking action against Interplay for trademark infringement.
Bethesda's concern stems from the publisher's desire to clearly distinguish between the previous Fallout releases and the most recent Fallout 3 release. Bethesda is also upset over the breaches in their trademark agreement because of Interplay's licensing agreements with various digital distribution sites that will sell the older Fallout titles.
